எனினும், குறித்த தகவல்களை வழங்க இராணுவம் மறுத்ததைத் தொடர்ந்து, தகவலறியும் ஆணைக்குழுவில் (RTI Commission) RTIC Appeal Case No. 1111/2022 (P. Nirosh Kumar Vs.

(Court of Appeal of Sri Lanka)

(President of the Court of Appeal)

Case Seeking Information on Surrendered LTTE Cadres: Judge Recuses Himself from Hearing!

Court of Appeal Judge Dhammika Todawatta has announced his recusal from the hearing of a petition seeking the release of information regarding Liberation Tigers of Tamil Eelam (LTTE) cadres who surrendered to the Sri Lankan Military during the final phase of the war.

Journalist B. Niroshkumar had requested information under the Right to Information (RTI) Act regarding the LTTE cadres who surrendered to the Sri Lankan military. However, following the military's refusal to provide the information, he filed an appeal with the Right to Information Commission (RTIC) under RTIC Appeal Case No. 1111/2022 (P. Nirosh Kumar Vs. Sri Lanka Army). Attorney-at-Law Swasthika Arulingam appeared on his behalf during these proceedings.

Unsatisfied with the ruling issued by the Right to Information Commission following several years of hearings on the appeal, journalist B. Niroshkumar filed a case against it in the Sri Lanka Court of Appeal in 2023.

After prolonged delays, it was decided during a previous hearing session to take up the case for argument on the 16th of this month.

Under these circumstances, the case was called last Friday before Judges Dhammika Todawatta and Manjula Tilakaratne. Attorney-at-Law Swasthika Arulingam appeared in court on behalf of journalist B. Niroshkumar.

During the proceedings, Judge Dhammika Todawatta announced that he was recusing himself from the hearing of the case.

He further stated that he would recommend to the President of the Court of Appeal to appoint a different bench of judges to hear the case.

Accordingly, the case is scheduled to be called before the President of the Court of Appeal on November 10th, on which day a decision regarding the panel of judges to hear the case will be announced.
